 AKS formed the third-party committee to investigate the incident.
 However, many criticize that the committee lacked neutrality, independence and expertise.

No response to the media by the committee members.

A journalist from Toyo Keizai called a committee member Mr. Iwasaki (lawyer) and asked for an interview. They responded “We are not allowed to speak to the media.  AKS is the only contact point about this so please ask questions to AKS including the permission of making an interview with us.”

Some pointed out that this is against the guideline of the Third-Party Committee which stipulates that the committee makes neutral and unbiased investigation independently from the corporation for the benefit of the stakeholder of the corporation.

Poor quality report.

 The report by the third-party committee was made public on 21 March 2019.  Many criticized its quality as there were many contradicting and ambiguous statements, which we discuss in detail later.
 Prior to the publication of the report, Mr. Hideaki Kubori (lawyer of Hibiya Park Legal Firm)who led many third-party committees in the past commented on Toyo Keizai.
 Fees paid to the committee is about JPY 20-30 million (USD 200-300,000).  In this case, I think the leader takes 10 million and the other takes 5 million each.
It is a good business for a certain segment of lawyers.
However, if you make reports to meet the demand of the corporation, your neutrality as lawyer will be suspected. 

On 22 March 2019, AKS who commissioned the investigation held a press conference to explain the result of the report without the presence of the committee members.  This was quite unusual.
Mr. Kubori replied via TV interview

“so, this is not worthy of the third-party committee?” 

“Not at all!
